These Terms of Service (“Terms”) govern your use of the Chic Bay website (the “Site”) and any purchases made through the Site. By accessing the Site or placing an order, you agree to these Terms.
1) General conditions
We reserve the right to refuse service to anyone for any reason at any time. You agree not to use our products or Site for any unlawful or unauthorized purpose.
2) Products and availability
All products are subject to availability. We may limit quantities, discontinue items, or change product offerings at any time without notice.
We make reasonable efforts to display product descriptions, images, and colors accurately, but we cannot guarantee that your device’s display will reflect colors precisely.
3) Pricing and promotions
Prices are listed in U.S. dollars unless otherwise stated. We may change pricing and promotions at any time. Promotions and discount codes may not be retroactively applied to past purchases and may have conditions or expiration dates.
4) Orders, payment, and acceptance
Placing an order does not guarantee acceptance. We may cancel or limit an order for reasons including suspected fraud, incorrect pricing, inventory issues, address problems, or other operational considerations.
Payment must be completed at checkout. If a payment is declined, the order will not be processed.
5) Shipping and delivery
Shipping timelines shown at checkout are estimates and not guarantees. Delivery delays caused by carriers, weather, holidays, or high-volume periods are outside our control.
Once an order is shipped, responsibility for delivery transfers to the carrier. If a package is marked delivered but is missing, customers should contact the carrier first and then contact us so we can assist where possible.
6) Cancellations and changes
Orders may be canceled within 2 hours of purchase. After this window, orders may already be in processing and cannot be canceled or changed
7) Returns and refunds
Returns and refunds are governed by our Return / Refund Policy. For hygiene and safety reasons, press-on nails and opened/used items are final sale.
8) Sizing photos (optional)
If you choose to upload a sizing photo on a product page, you agree you have the right to upload it. We will use the photo to size your set as accurately as possible for your order. Please avoid uploading sensitive personal information.
9) Intellectual property
All content on the Site—including logos, product names, text, graphics, and images—is owned by or licensed to Chic Bay and may not be copied, reproduced, or used without written permission.
10) User content
If you submit content (reviews, photos, messages), you grant Chic Bay a non-exclusive right to use, reproduce, and display that content for store operations and marketing, unless you request otherwise in writing.
11) Disclaimer of warranties
The Site and products are provided “as is” and “as available,” to the fullest extent permitted by law. We do not guarantee uninterrupted access to the Site or that the Site will be error-free.
12) Limitation of liability
To the fullest extent permitted by law, Chic Bay will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Site or products. Our total liability for any claim will not exceed the amount you paid for the product(s) giving rise to the claim.
13) Indemnification
You agree to indemnify and hold harmless Chic Bay from claims arising out of your breach of these Terms or misuse of the Site.
14) Governing law
These Terms are governed by the laws of the United States and the State of Florida, without regard to conflict-of-law principles.
15) Changes to these Terms
We may update these Terms from time to time. The “Last updated” date will reflect the most recent revision. Continued use of the Site constitutes acceptance of the updated Terms.
